Important Update on Tree Removal
The City would like to remind property owners that tree removal is subject to the requirements of the City's Tree Preservation Ordinance, located in Article 7, Part IV of the Unified Development Ordinance (UDO).
Recent amendments to the ordinance have changed the requirements for tree removal. Please review the following information before clearing or removing trees.
Residential Property. Tree removal permits are no longer issued for tree removal on residential property. However, the removal of certain trees designated as significant trees under the ordinance requires mitigation based on the total diameter at breast height (DBH) of the trees removed. Significant trees are defined as: Any tree 24" DBH or larger, and Flowering Dogwoods, Live Oaks, and American Hollies at least 8" DBH.
Diameter at breast height (DBH) is the diameter of a tree trunk measured at 4.5 feet above the ground. Measure the circumference of the tree at 4.5 feet above ground level and divide by 3.14 to calculate the DBH. Before removing a significant tree, please contact the Planning & Zoning Department. Staff will conduct an inspection and assist in determining the applicable tree mitigation requirements based on the total DBH of significant trees to be removed.
Non-Residential Property. Clearing of trees on non-residential property may not occur until a development plan has been approved in accordance with the UDO. No property shall be cleared in anticipation of future development prior to approval of the applicable development plan.
Federal and State Requirements. Compliance with the City's Tree Preservation Ordinance does not exempt property owners from complying with other applicable federal, state, or local laws and regulations, including the Endangered Species Act (ESA).
Before removing pine trees, the U.S. Fish & Wildlife Service asks that landowners, applicants, and consultants in Boiling Spring Lakes use their online review process and the Information for Planning and Consultation (IPaC) tool available online at the U.S. Fish & Wildlife Service Boiling Spring Lakes RCW Consultation page.
If you have questions, or if you are unsure how the requirements apply to your property, please contact the Planning & Zoning Department at (910) 294-0996. Our staff are happy to answer your questions, explain the requirements, and help you determine any applicable mitigation requirements.
